1. Acceptance of Terms

ThynkUnicorn provides digital marketing services, including but not limited to SEO, PPC (Performance Marketing), Brand Strategy, and Web Development.

• Specific deliverables, timelines, and costs are outlined in individual Client Agreements or Statements of Work (SOW).
• We reserve the right to refuse service to anyone for any reason at any time.

3. Intellectual Property

Client Ownership: Upon full payment, the client owns the specific creative deliverables and content created specifically for their project.

Agency Rights: ThynkUnicorn retains the right to use the work for portfolio, self-promotion, and case study purposes. We also retain ownership of our background technology, frameworks, and pre-existing methodologies used to create the deliverables.

4. Payment & Billing

• Invoices are due upon receipt unless otherwise specified in your Service Agreement.
• We reserve the right to pause or terminate services for accounts that are past due.
• All fees are non-refundable unless explicitly stated otherwise in your specific contract.

5. Limitation of Liability

While we strive for excellence, digital marketing results (such as Google rankings, ad performance, or ROI) can be influenced by third-party platforms (e.g., Google, Meta) and market conditions outside our control.

6. Third-Party Tools

Our services may utilize third-party tools (e.g., Google Analytics, HubSpot). You agree to comply with the terms of service of these third-party providers. We are not responsible for the availability or accuracy of these external resources.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.
